Peakub Terms of Service

Welcome to Peakub! By using our platform and services, you’re agreeing to the terms below. Please read them carefully.

1. Accepting These Terms

This document and the Peakub Privacy Policy (together, the “Terms”) govern your access to and use of the website, products, services, and applications (the “Services”) offered by Peakub, Inc. (“Peakub”, “we”, “our”, or “us”). By using Peakub, you agree to these Terms. If you don’t agree, you may not use our Services.

Peakub gives you creative control and ownership of your audience.

2. Who Can Use Peakub

You must be at least 13 years old to use Peakub. If you are using Peakub on behalf of another person or entity, you confirm that you have the authority to do so, and that the entity agrees to the Terms.

3. Your Content

You retain ownership of any intellectual property rights in the content you upload or publish using Peakub (“Your Content”). By publishing on Peakub, you grant us a limited, non-exclusive, royalty-free license to host, store, and display Your Content solely for the purpose of operating, developing, and promoting the Services.

You are responsible for Your Content. That means:

• You must have the rights to the content you publish.
• You must not publish anything that violates the law or any third party’s rights.
• You must not use Peakub to harass, defame, or harm others.

Peakub is a canvas for independent visual creators and curators.

4. Your Subscribers

If you publish on Peakub and attract followers or subscribers, those people are yours, not ours. You own the email list and any data collected via your publication (to the extent allowed under the law). We will never contact your subscribers for marketing purposes without your permission.

However, you are responsible for managing your subscriber relationships. That includes:

• Complying with applicable privacy and anti-spam laws.
• Honoring subscriber preferences and opt-outs.

Your audience, your rules.

5. Monetization

Peakub allows creators to earn money through paid subscriptions, tips, and other tools. By enabling these features:

• You agree to our Monetization Terms.
• You are responsible for reporting and paying any taxes.
• We may deduct platform fees and payment processor charges.

Peakub is not a bank, and we don’t provide financial services. Payments are processed by third-party providers like Stripe.

6. Our Rights

To protect the Peakub community, we may need to:

• Remove or restrict content that violates our policies or applicable law.
• Terminate or suspend accounts that abuse our platform.
• Modify or discontinue the Services at any time.

We’ll try to notify you in advance when possible, but we reserve the right to act swiftly to protect our platform, users, or legal interests.

7. DMCA and Copyright

If you believe your copyrighted content has been posted on Peakub without permission, please follow our DMCA Procedure to file a takedown request. We comply with the Digital Millennium Copyright Act.

8. Third-Party Services

Our Services may include links to third-party websites or tools. Peakub is not responsible for those sites or services. Use them at your own risk.

9. Changes to the Terms

We may update these Terms from time to time. When we do, we’ll post the new version on this page and update the “Effective Date” at the top. If changes are significant, we’ll notify users by email or through the platform.

Continuing to use Peakub after changes become effective means you agree to the new Terms.

10. Termination

You can stop using Peakub at any time. We may suspend or terminate your account if you violate these Terms or use the platform in a way that puts Peakub or our users at risk.

Some sections of this agreement will survive termination, including those concerning intellectual property, liability, and dispute resolution.

11. Disclaimer and Liability

Peakub is provided “as is,” without warranties of any kind. We are not liable for damages that result from your use (or inability to use) the Services, except where prohibited by law.

Some jurisdictions do not allow the exclusion of certain warranties or limitations, so parts of this section may not apply to you.

12. Governing Law

These Terms are governed by the laws of France, without regard to conflict of laws principles. Any disputes will be resolved in the courts located in France.
