Peakub DMCA Policy

Peakub respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (“DMCA”). This policy explains how to report copyright infringement and how we handle those reports.

1. Reporting Copyright Infringement

If you believe that content on Peakub infringes your copyright, you may submit a DMCA takedown notice to our Designated Agent with the following information (as required by 17 U.S.C. § 512(c)(3)):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the infringing material, including its location on the platform (e.g., a URL).
4. Your contact information, including your name, address, telephone number, and email.
5. A statement that you have a good-faith belief that the use of the content is not authorized by the copyright owner, their agent, or the law.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Please note: Submitting a false or bad-faith claim may result in liability under Section 512(f) of the DMCA.

2. Counter Notification

If you believe your content was removed by mistake or misidentification, you may file a counter notification with our Designated Agent. Your counter notice must include:

1. Your physical or electronic signature.
2. Identification of the content that was removed and where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification.
4. Your name, address, phone number, and email address.
5. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., the jurisdiction of any U.S. judicial district), and that you will accept service of process from the person who submitted the original takedown notice.

Upon receiving a valid counter notice, we may restore the removed content unless the original complainant files a court action within 10 business days.

3. Repeat Infringers

Peakub may, in appropriate circumstances, suspend or terminate users who are repeat infringers of intellectual property rights.
